These Terms of Service ("Terms") govern your access to and use of the Human Clarity Institute website, assessments, reports, and related products and services (together, the "Services"). By using the Services — including by taking an assessment or making a purchase — you agree to these Terms. If you do not agree, please do not use the Services.
1. Who can use the Services
You must be at least 18 years old to use the Services, take an assessment, or make a purchase. By using the Services, you confirm that you are 18 or over and that the information you provide is accurate.
2. What we provide
We provide research-based assessments and personalised reports relating to how people interact with AI. When you complete an assessment and purchase a report, we generate a personalised report based on your responses, made available to you on-screen, by email, and as a downloadable document.
Our reports are produced using automated and AI-assisted methods and are benchmarked against research data we have collected. They are provided for personal insight, reflection, and informational purposes only.
3. Not professional advice
Our assessments and reports are not professional advice and are not a substitute for it. They are not psychological, medical, mental-health, legal, financial, or other professional assessment, diagnosis, or advice. They are not a clinical instrument and must not be used for diagnosis or for any decision where professional advice is appropriate. If you have concerns in any of these areas, please consult a qualified professional.
4. Purchases, pricing, and delivery
Pricing. The price of any product is shown at the point of purchase. We may change our prices and the products we offer at any time; the price that applies to you is the one shown at checkout when you buy.
Payment. Payments are processed by our third-party payment provider. By purchasing, you authorise us (via that provider) to charge the applicable amount.
Delivery. Reports are generated and delivered electronically, usually immediately or shortly after purchase. By purchasing, you acknowledge that delivery begins promptly after payment.
Your responsibility. You are responsible for providing a valid email address for delivery. We are not responsible for non-delivery caused by an incorrect address you provide, though we will help you retrieve a purchased report where we reasonably can.
5. Refunds and our satisfaction commitment
We want you to be satisfied with what you purchase. If a report fails to deliver, or you are genuinely unsatisfied with it, contact us within 7 days of purchase at info@humanclarityinstitute.com. We will first work to fix or regenerate the report; if we are unable to resolve the issue, we will provide a refund.
This satisfaction commitment is in addition to, and does not limit, any rights you have under the consumer-protection laws of your country of residence. Nothing in these Terms removes or reduces any mandatory statutory rights you may have.
6. Intellectual property
All content we provide — including assessments, reports, benchmarks, research outputs, text, graphics, and software — is owned by Northstead Limited or our licensors and is protected by intellectual-property laws.
When you purchase a report, we grant you a personal, non-exclusive, non-transferable licence to use your own report for your personal, non-commercial purposes. You may not copy, resell, redistribute, or commercially exploit our content (including reports, assessments, or benchmark data) without our prior written permission.
7. Your responses and how we use them
When you take an assessment, you provide responses that we use to generate your report and, in anonymised and aggregated form, to conduct research and improve our Services. Our handling of your personal information is described in our Privacy Policy. By using the Services you grant us a licence to use your responses for these purposes. We do not claim ownership of your personal information; our use of it is as described in the Privacy Policy and is based on the legal bases and consents set out there.
8. Acceptable use
You agree not to:
- provide false information or misrepresent your participation;
- use the Services unlawfully, or for any harmful, misleading, or fraudulent purpose;
- scrape, bulk-download, copy, or redistribute our content or data without permission;
- attempt to disrupt, compromise, or gain unauthorised access to the Services; or
- attempt to re-identify any individual from any anonymised data we publish.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties of any kind, express or implied, regarding the Services, including as to accuracy, reliability, fitness for a particular purpose, or uninterrupted availability. Reports reflect patterns in your responses at a point in time and are interpretive, not definitive.
This Section does not exclude any warranties or guarantees that cannot be excluded under the law of your country of residence.
10. Limitation of liability
To the maximum extent permitted by law, Northstead Limited will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability to you for any claim relating to the Services will not exceed the amount you paid us for the product giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability under mandatory consumer-protection laws in your country of residence.
11. Changes to the Services or these Terms
We may update the Services and these Terms from time to time. Changes take effect from the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of New Zealand. The courts of New Zealand will have jurisdiction over any dispute, except that, where you are a consumer, you retain the benefit of any mandatory protections and any right to bring proceedings under the laws of your country of residence.
